Terms of Service
These Terms of Service ("Terms") govern your use of the Swoshel website at https://swoshel.myshopify.com (the "Site") and purchases from Swoshel ("Swoshel," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility and accounts
You must be the age of majority where you live, or have parental/guardian consent, to use the Site and buy products. You are responsible for accurate account information, securing your credentials, and activity under your account.
2. Platform and payments
The Site is hosted on Shopify. Payments are processed by Shopify and/or other payment providers under their terms. We do not store full payment card numbers on our own servers.
3. Products and descriptions
We aim for accurate product descriptions and images. Colors can vary by screen. We may limit quantities, refuse or cancel orders (including suspected fraud or pricing errors), and discontinue products at any time.
4. Pricing
Prices are in US dollars (USD) unless stated otherwise. Taxes and shipping are shown at checkout where applicable. Import duties and similar fees for international orders are your responsibility unless checkout states they are included. If we discover a clear pricing error before or after acceptance, we may cancel and refund the affected order.
5. Orders, shipping, and returns
Your order is an offer to buy. A contract forms when we accept the order (typically by charging payment and/or sending an order or shipping confirmation). Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy. Those policies are part of these Terms. Where mandatory consumer law (including EU/EEA/UK distance-selling withdrawal rights) gives you stronger rights than our voluntary policies, those mandatory rights prevail.
6. Intellectual property
Site content, branding, and product designs are owned by or licensed to Swoshel and protected by law. Buying a product does not transfer IP rights in the design. You may not copy, scrape, or commercially reuse Site content without prior written permission.
7. User content
If you submit reviews or other content, you grant Swoshel a non-exclusive, royalty-free, worldwide license to use and display it in connection with the Site and our business. You must not submit unlawful or infringing content.
8. Prohibited uses
You may not use the Site unlawfully; attack or overload the Site; scrape without permission; submit malware or false information; or infringe others’ rights.
9. Third-party services
We are not responsible for third-party sites, tools, carriers, or payment providers.
10. Disclaimers
Except for warranties that cannot be excluded under mandatory law, the Site and products are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted.
11. Limitation of liability
To the fullest extent permitted by law, Swoshel will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Mandatory consumer rights in your country (including in the EU/EEA/UK) are not excluded where they cannot lawfully be limited.
12. Indemnity
You agree to indemnify Swoshel against claims and costs arising from your breach of these Terms or misuse of the Site, to the extent allowed by law.
13. Privacy
Our Privacy Policy explains how we handle personal information.
14. Governing law
These Terms are governed by the laws of the United States and the state in which Swoshel operates, without conflict-of-law rules, except that mandatory consumer-protection rules of your country of residence (including EU/EEA/UK rules) continue to apply where they cannot be waived.
15. Changes
We may update these Terms by posting a new version on this page. The “Last updated” date will change. Continued use after posting means you accept the updated Terms, subject to mandatory law.
16. Severability
If one provision is unenforceable, the rest remain in effect.
